國內勞動權益相關法規在FSC森林管理驗證適用性之探討

Investigate Applicable Laws and Regulations on Labor Rights of Taiwan to the Forest Management (Fm) of the Forest Stewardship Council (Fsc)

摘要


本研究目的在探討FSC森林管理驗證標準第5版之「原則2」所提及之勞工權益與雇用條件,並比較分析國內目前已頒布適用該原則之相關法規,以期分析結果可提供未來國內在推展FSC森林驗證實務時,林業主管機關與林業經營組織有充足相關資訊足以依循,並利於在申請FSC森林管理(FM)驗證作業時可以瞭解是否符合驗證規範之程度,以提高獲得驗證通過機會。分析結果顯示,我國涉及勞動條件及勞動權益並與林業經營實務相關之法規,初步歸納計有39項,其中「勞動基準法」、「勞工保險條例」、「職業安全衛生法」、「勞資爭議處理法」、「性別工作平等法」、「工會法」與「職業災害勞工保護法」等均為我國保障勞工職業權益之重要法規,其多層面之周詳規範,在保障從事森林活動勞工之勞動權益上,甚已超越國際勞工組織核心公約之建議與FSCFM驗證標準之規範要求。我國森林管理組織只要恪遵我國該等與勞動條件及勞動權益相關法規,在FSCFM驗證程序中自可全面符合「原則2-組織應維持或提高勞工之社會福利及經濟利益」相關準則之規範。

The purpose of this study was not only to discuss the "principle 2", which is workers' rights and employment conditions mentioned in the FSC Principles and Criteria version 5, but also to analyze and compare the domestic laws and regulations which have been enacted presently with principle 2. Results were expected to be able to provide forestry authorities and forest management organizations with sufficient information to develop FSC forest certification practices in the future. Meanwhile, forest management organizations could understand whether the degree of certification standards meet or not, what will be usefully to increase the chance of approval certification while applying for FSC forest management (FM) certification administration. Results show that there were 39 domestic laws and regulations involve with labor conditions, rights and forest management practices which include "Labor Standards Act", "Labor Insurance Act", "Occupational Safety and Health Act", "Act for Settlement of Labor- Management Disputes", "Act of Gender Equality in Employment", "Labor Union act" and "Act for Protecting Worker of Occupational Accidents". These acts were important regulations to protect the rights of workers' occupation in Taiwan and their detailed design transcend the suggestions of ILO conventions on core labor standards and the requirements of FSC FM. Forest management organizations as long as abide by the domestic labor conditions, labor rights and other relative laws and regulations that could fully conform with the "Principles 2: the organization shall maintain or enhance the social and economic wellbeing of workers" in FSC FM certification procedure.
