摘要

電腦軟體已經是社教機構，尤其是圖書館所必須具備之重要工具，不論是館內業務人員或是館外的廣大讀者都必須加以使用。但近年來電腦軟體之不當使用及仿冒情形仍時有所聞，特別是幾家著名之美商電腦軟體公司所集資設立之「美國商業軟體連盟」（BSA: Business Soft-ware Alliance）最近不斷提出法律控訴，值得圖書館業者警惕。本文爰就電腦軟體著作權之相關規定、如何合法使用軟體，包括圖書館內一般使用、個人電腦網路上之使用，電子佈告欄（BBS）之使用，以及電腦軟體使用者應有之管理觀念加以介紹，以免侵權。

The computerization of library opertions presents a challenge for software users both within and without the walls of the library. Difficult copyright issues arise in this new ”virtual library”, an amalgam of computer networking, bulletin board system (”BBS”) and CD-ROM libraries, for users and developers alike.The biggest copyright issues in recent years have been the counterfeiting and unauthorized use of computer software. For example, several famous United States computer software companies have formed the Business Software Alliance (”BSA”) and brought a series of relentless legal actions against infringers and unauthorized users of their software. These suits and other phenomena have served to create great public interest in exactly how to avoid copyright infringement.In response to this demand, this article introduces solid software management concepts for all of users. It will show library how to expand its software usage into the new era while avoiding copyright infringement.
