從立法過程論臺灣地區都市計畫法
Discourse of Urban Planning Law in Taiwan: A Legislative Process Analysis
摘要
本文從政策分析及法律案設計的觀點，分析台灣地區都市計畫法變動的趨勢，並進而檢討。文分五部分： 第一部分：法律性質與立法過程，敍述法律設計的可能性及都市計畫法的位置。 第二部分：文獻回顧，分析十篇檢討台灣都市計畫法的文獻，並指出本文旨趣。 第三部分：都市計劃法案的設計，分別析論都市計劃制度設計原則；都市計畫的法律性質及都市計畫法的應有內容。 第四部分：都市計畫法立法過程分析，分別析論都市計畫法於民國53年，民國62年，民國77年的三次修法的立法重點；立法爭議以及由歷次修法所聯結起來的都市計畫法變動的主要趨勢。 第五部分：推論與結論，對都市計畫法變動的主軸的負面評價，及此變動趨勢對都市計劃制度的解構的分析；對都市計畫法變動的主軸的正面改進意見，以四點建議提出為一結論。

This thesis analyze the trend of urban planning law in Taiwan area, with the viewpoint of policy analysis. It includes five part: Part one: Nature of law and legislative process: Describe the position of urban planning law in the law system. Part two: Artical review: Includes ten articals review and the problematic of thisthesis. Part three: The design of urban planning law: Includes the principle of institutional design; the nature of urban planning law and the content of urban planning law. Part four: the legislative process of urban planning law: Includes the essence of urban planning law; the main issue in revision of urban planning law at 1964, 1973 and 1983, the trend of transformation in urban planning law. Part fve: epilogue.
