論德國都市更新制度－兼論我國都市更新法制

德國都市更新制度規定於該國之建設法典中，不僅在理論體系上十分完整，而且制度設計亦面面俱到，誠有供我國借鏡之處。因為我國目前正極力推動都市更新，甚至於已有「都市更新條例」草案之提出。所以本論文仍以德國法之介紹為主軸，旁諸於我國現行都市計畫法中有關都市更新章中之規定，加以比較並分析其優劣，希望一方面有助於我國推動都市更新之際，能掃除對此制度之疑慮及排斥，另外一方面也希望有助於建立我國完整可行之都市計畫制度，使得都市中之不良地區，可以透過都市更新之手段，重獲得第二春之生命力，提高人民居住之生活品質。

This article introduces the said system and compares the related statutes in the Urban Planning Law of the Republic of China. With the German system as a reference, establish the same system in Taiwan so as to renovate the rough region and improve the quality of the resident's life.
