摘要

礦業開發案件之申請程序，依礦業法規定可分為2階段︰礦業權之設定與礦業用地之核定。至於礦業法所稱「核定礦業用地」，究指核定「土地」或「計畫」，從字面上不易判斷，常造成誤解。因此，本文藉由礦業開發與土地管制的法制面及程序面來分析、探討，並說明「核定礦業用地」之實質意函，其本質就是「審查」的動作，而審查的物件，則是「土地之使用計畫」，提供給礦業界人士參考。
