摘要

中華民國十七年十月八日公布國民政府組織法，確定中共政制為五院，本論文以五院之中央政治制度，討論其組織與職權。起自清末民初，與民國十四年國民政府成立，迄行憲前止，我國中央制度之演進，走向現代化之重要過程。民國十七年之國民政府組織法，在歷次組織法中最為重要。一、該法試行國父孫中山先生之五權憲法制度。二、自民國十七年迄行憲前，除了內閣制問題略有變化外，大體上未脫離該法之規模。本文以此次組織法為主，此後歷次之修訂為輔，論其在現代中國法制演進中所處之地位。

The Organization Law of the National Government was promulgated on October 8, 1928, it Jetermined that the system of the Central Government would be five-yuan. The essay explores the organization and authority of the live yuans in the Central Government and the development of the system of the Central Government until 1947.The Organization Law of the National Government of 1928 is the most important among those organization Laws. The reasons are (a) the Organization Law of 1928 tried out the system of the five-power constitution alleged by Dr.Sun Yat-sen, and (b) the system of the National Government followed the Organization Law generally until 1947 in addition to a little change in the problem of the cabinet. Therefore, the essay focuses on the organization Law of 1928 and sypplemented by the revises of it to discuss the role of the Organization Law of 1928 in the development of the China legal system today.
