摘要

憲法是人民權利的保障書，平等、正義、人類尊嚴等理念構成憲法的核心部分，軍人與一般人民相同，也應該享有憲法之基本權利，本文首先討論平等權之意義，進而論及限制軍人權利之各項理論，最後並就實證法提出若干建議，期能引起各界對軍人權益之重視。

Constitution is a safeguard for people's rights in a country. The rational concepts of equality, the justice and human dignity form the core part of the Constitutional Law. Basically, the soliders should have the same fundamental rights conferred and protected by the constitution as the citizens. The present paper first discusses the meaning of the equal right, then explores the related theories about the restrictions of solider's rights, and finally makes some suggestions for the prevailing positive law. In conclusion, the paper expects the pubic will pay attention to the prospective improvement of soldiers' legal rights.
