The Five-power constitution is a crystallization of Dr. Sun Yat-sen's views on the varius foreign constitutions he studied as well as on the traditional chinese politica1 ideas and institutions that he found worthy of imitation or incorporation. The constitution, the aim of which is to establish an ablest government, is based on the theory of the ”separation of the power to rule and the power to administer.”It was to build a republic founded on the Five-power Constitution that Dr. Sun staged the National revolution. And now the Republic, so conceived and so founded, has largely deviated from the spirit of the Constitution. In true intents and meaning of the Five-power Constitution, hoping that the discussion will be of some help to the readjustment of the ROC's constitutional development here on Taiwan.
