外籍勞工爭議樣態分析:以新北市政府2008年1月至2011年6月處理的外籍勞工爭議案紀錄為例

摘要


本文探討外勞爭議件數、分布比率、發生率等樣態與變化,同時討論外勞爭議變化與景氣波動之關係,及預防外勞爭議的政府作為之效果。使用資料為新北市政府2008年至2011年6月的外勞爭議案處理紀錄,採取次數分配和百分比分布的分析方法。主要發現如下:整體爭議件數隨外勞人數增加而趨增,但發生率於2010年增加、2011年下降;爭議類別以工資爭議居首,且呈現趨增;爭議的雇主業別分布比率以家庭看護和製造業為最多,前者遞減,後者則遞增;外勞國籍爭議發生率一直以越南外勞居首;性別的爭議發生率男性高於女性,差距有增大趨勢,但兩者都趨緩;受理方式以電話(1955專線)居首。整體和製造業的外勞爭議件數趨增,與景氣復甦期會降低爭議的預期相反;預防外勞爭議的政府作為之效果,體現於契約爭議和仲介問題之減少,及家庭類外勞爭議發生率趨降,但1955專線促進爭議檯面化。本文最後提出一些預防外勞爭議的建議。

This article intends to explore the trend of foreign workers' disputes with respect to number of cases, proportion and probability. The data utilized are foreign workers' disputes records handled by New Taipei City over the period from January 2008 to June 2011. The methods adopted include frequency analysis and proportion distribution. The major findings are the following: The grand total cases of foreign workers' disputes are increasing but not the probability. The primary type of disputes is related to wage, whose proportion is increasing. Disputes related to family workers and in the manufacturing are two major types of industry, yet probability of disputes declines related to family workers while increasing in the manufacturing. Male consistently have a higher probability of disputes than female. With respect to source countries, Vietnamese always show the highest probability of disputes. The total cases and the cases in the manufacturing do not decline in 2010-2011 as expected. As for the effectiveness of governmental actions to prevent foreign workers' disputes result in declining contract disputes, problems of intermediary agency, probability of disputes related to family foreign workers, while the 1955 hotline has promoted more disputes to be reported.
