論德國功能自治行政之概念及其類型－附論我國現況

自治行政不但是國家行政組織原則，更涉及國家任務之有效達成。自治行政可區分為地方自治行政以及功能自治行政。本文之主要目的在於介紹德國各種功能自治行政之類型，並分析歸納出功能自治行政之共通要素，進而檢視我國功能自治行政之現況，提出法制上改革之建議。國內近來發生的爭議問題，例如農田水利會之存廢、國立大學校長之聘任等，皆屬功能自治行政領域之問題。而原住民族部落劃定之爭議，亦與功能自治行政有關。本文希望能對這些問題提供一些思考方向。

Self-administration is not only one of the important principles of state organization, but also it concerns efficiency of the functions of the state. Self-administration includes local self-administration and functional self-administration. The purpose of this article is to introduce different forms of self-administration in Germany, and to analysis their common elements. After that the domestic status of functional self-administrations would be examined. Finally this article proposes suggestion for legal reforms. Recent controversial issues in Taiwan, for example the abolition of irrigation association, engagement of the president of national university, they all belong to the field of functional self-administration. And boundary settlement of indigenous tribe also relates to functional self-administration. This article also provides some ideas on these issues.
