摘要

在全球治理脈絡下，組織性犯罪已漸從國家擴及為國際安全上之威脅，且特別是此種犯罪已涉及跨國活動，致必須各國共同加以打擊。對於組織性犯罪理論之建構已漸朝向多學科方向努力，並擷取不同方法與觀點加以解釋，可概歸類為三個主要的理論模型，即「外國人同謀／官僚制度」模型、「保護者－顧客關係」模型與「企業途徑」模型。目前國際之防制作為，是以系統性途徑找出對付組織性犯罪之最有效策略，並聚焦於目標與政策兩個要素。然實踐上之最大困難，仍在於各國間如何有同樣強度之打擊共識，才可能將各種配套措施作最佳之運用。

Under the context of Global Governance, organization crime already gradually from the nation and expand to become the threat of the international security, and especially this kind of crime has already involved the multinational activity, with the result that have to all countries, administers against together. The construction of the organization crime theories already gradually toward an multi-disciplinary of effort, and pick different of the methods and standpoints to take into explain, can categorize to three main theoretical models all, namely the alien-conspiracy/bureaucracy model, patron-client model and enterprise approach model. The Counter-measure of international currently of dealing with the organization crime is ”system approach,” and are focus two main factors, target and policy. However, the biggest difficult of fulfillment is still lying in how all countries have the stroke consensus of the same strength, just making various integration the best probably of usage.
