中國大陸農村土地制度創新的路徑選擇－土地使用權流轉之探討

摘要

土地使用權流轉雖有助於克服農村因承包制均分土地，導致土地細碎化、分散化及農民棄耕抛荒等問題，亦符合發展社會主義市場經濟、推動規模經營的要求。但是，中國大陸農村各地生產力發展的不平衡，以及土地在農村大部分地區仍擔負就業和社會保障的功能，故推動土地使用權流轉除需因地制宜外，中國政府若能賦予農民長期的土地使用權，完善土地使用權登記制度，建立農村土地使用權流轉機制，發展土地租賃市場及農村二、三產業，統一城鄉社會保障制度，始有助於農村經濟朝產業化、規模化及現代化的方向發展。

Rural lands transacted through the right of ownership may be better than the theory of average rent distributions, wherein lots are commonly being divided to smaller pieces because it helps prevent farmers from abandoning their lands and hence, their produce. It is equally befitting under a developing socialist's market economy and scale management such as China. But in actuality, Mainland China's development of rural productivity is imbalanced for lands in large areas must also help sustain employment. So regional conditions aren't the only criteria to be considered when promoting lands through transactions, farmers should also be given the option of investing in their own lands in the long term and must be given the right of ownership, plus the land must be officially registered. Therefore, it is advisable for large rural economies trying to modernize to increase rural lands using the right of ownership system or the land leasing market system, and to develop more secondary and tertiary industries in rural villages. This kind of reform strategies and social protection programs can better support and assure the villagers.
