摘要

就少年司法的發展而言，各國通常採用以刑罰為基礎的刑事模式或以國家親權為基礎的福利模式應對少年犯罪，但效果不彰，因此少年司法政策不斷在兩者之間擺盪來回。修復式司法理論的提出，為少年司法的發展開闢了新的方向。透過加害少年與被害人的對話與瞭解，使少年真心悔悟並順利回歸社會，受害人的傷痛也得到修復。

In the history of juvenile justice, countries usually adopt criminal or welfare model to deal with juvenile delinquency or crime. But it proved ineffective, and the juvenile justice policy continues to swing back and forth between the two. Restorative justice has provided a new direction for juvenile justice system, through dialogue and understanding between the youth and the victim, so that the youth repents sincerely and successfully returns to society, the victim's pain has also been relieved.
