摘要

物理治療是一門具專業技術之職業。執行物理治療師業務必須具備相當之資格、持有物理治療師證書及執照始得執行物理治療之業務。實習物理治療師雖未取得合法之資格，但是在法定的條件下，仍可以執行法律所賦予的部分物理治療師業務，因此，實習物理治療師仍需面對或承擔物理治療師所遭遇的倫理及法律問題。本文主要探討實習物理治療師之角色、權限與責任，以及我國關於實習醫療人員醫療疏失責任歸屬之法律概況，並提出大家應正視此問題，希望能將實習物理治療師也納入保險之建議。文中將以兩個實習物理治療師醫療傷害為例。希望本文能提供物理治療同業在臨床相關實習業務上之參考。

Physical therapy is a medical health care profession. Physical therapy interventions shall be performed by physical therapist with qualified clinical certificate. A physical therapy intern shall comply with laws that states that specific physical therapy interventions should be provided only under the direction and supervision of a qualified physical therapist. So, the physical therapy interns shall comply with ethics norms and bear legal responsibilities in clinics. The purposes of this article were to investigate the professional role and responsibilities of physical therapy interns, and to review the survey of the laws of medical negligent actions and attribution of responsibility. We provided two medical injury examples that physical therapy interns were involved in. We expect to provide recommendations that could be beneficial to establish related policies and regulations of physical therapist interns.
