摘要

德國限制競爭防止法係立法於1957年，而於次年之1月1日施行。限制競爭防止法至今總共已經過7次之修訂。最近的一次修正係於2005年7月15日，其目的在於調和德國與歐體之競爭法，使其趨於一致，同時也進行了諸多其他的必要修正。尤其是關於限制競爭協議之部分，德國法配合歐體法作了重大之調整。本文之主要工作，在於將德國限制競爭防止法之全文翻譯成中文。為了使讀者能夠很快瞭解第7次修法的要旨，作者並於全文之始略述本次修法之重點，以使讀者能夠掌握德國競爭法之最新發展。

The German ”Act Against Restraints of Competition” (GWB)was enacted in 1957 and enter into force on Jan.1, 1958. The GWB has had totally 7 amendments. The latest amendment of July 15, 2005 harmonized the German antitrust law with the European competition law, especially in terms of the agreements restricting competition. The major task of this paper is to translate the GWB into Chinese language. However, the complete translation of the statute is headed with a brief introduction of this amendment, with the hope to help the readers to catch a quick picture of the newest developments of the German competition law.
