摘要

歐洲共同體（歐體）競爭法自2004年5月1日起，在反托拉斯案件的執行方面有了重大改變。在「分散執行權力」的政策指導下，理事會首先發佈第1/2003號規則，並陸續發佈第773/2004號執行規則暨6項有關的公告以爲配套，形成所謂的「執行程序現代化包裹」，建構歐體反托拉斯案件的全新執行體制。在此制之下，執委會將與各會員國競爭機關及法院，分享反托拉斯法的執行權力，除了有助於歐體競爭法的落實，亦能減輕執委會負擔，使執委會得以專注處理真正嚴重影響競爭秩序案件，促進歐體競爭政策的發展。本文的主旨有二，第一部分介紹在歐體競爭法執行機制中地位重要的第1/2003號規則的背景及其立法要旨，第二部分則將本規則全文譯成中文，便於讀者對本規則的瞭解，也便於主管機關實務上的參考。

As of 1 May 2004, the reformed EC competition policy had come into force within the entire EU territory which now has 27 member states in it. With the guiding principle of decentralization of the enforcement power, the fundamental Regulation, Council Regulation 1/2003, was first promulgated and followed by Commission 773/2004 as well as other six supplemental Notices in sequence, those of which together had become the content of the so called ”Modernization Package” By way of this reform, the enforcement of EC anti-trust law would be more integrated into the legal system of the individual member state, and the competition law culture would be spread more widely and rooted more deeply; and meanwhile, the Commission could get rid most of its enforcement burden and concentrate on the truly seriously anti-trust law-violated cases, which is contributable to the development of the EC competition policy. This article is composed of two parts; the introduction of the EC newly reformed anti-trust law enforcement system comes first, highlighting the essentials of this reform, and follows the Chinese translation of Regulation 1/2003 article by article, hopefully bringing assistance for readers and our competition authority in practice.
