摘要

本文以「線上搜索在警察法領域內實施之法律問題」作為研究主題。首先，本文就線上搜索在技術上的背景予以說明，其次，再對線上搜索於憲法及行政法層次的法律問題進行深入闡述。就憲法層次的法律問題而盲，本文剖析此一資訊蒐集措施對哪些基本權造成干預，而其造成之基本權干預又是否能取得合憲之評價。就行政法層次的法律問題而盲，本文則探究此一資訊蒐集措施的法律性質，並論述人民不服此一資訊蒐集措施得採取之行政救濟途徑。

The goal of this paper is to discuss the legal issues of online searches in the area of police law. To that end, the article is structured as follows. The first section describes the technical background of online searches. The second section analyses constitutional questions, including the intervention of the constitutional rights and its justification. Finally, the issues of the administrative law are presented. More specifically, the third section clarifies the legal nature of the online searches in the area of police law and its legal process.
