本國法律條文對病人醫療隱私權清楚規範以具體展現對病人尊重的保障。醫療紀錄承載著病人隱私,具高度敏感的特殊私密性質,病人有維護病情不為外人所知的自主權。護理人員被賦予保護病人隱私及守密的義務,在醫療意見交流時須落實護理資訊素養內涵以保障病人權益。然未經當事者同意公開在網路社群媒體討論及分享案例、上傳或轉載病人影像揭露醫療訊息,導致網路倫理爭議案件日益增加。本文旨在陳述病人隱私權、資訊便利對隱私的侵犯、醫療隱私揭露的考量,最後分享護理資訊倫理素養培育教學策略建議,期能藉此提升護理人員使用社群媒體的倫理素質落實病人隱私維護。
Legal provisions in Taiwan clearly define patients' medical privacy rights and are aimed at showing respect for patients. Medical records carry patient privacy, are highly sensitive in nature, and have a special place in privacy regulations. Patients have the autonomy to maintain their medical privacy not known to outsiders. Nurses are given the obligation to protect patients' privacy and confidentiality. Patients' privacy must be considered in the exchange of medical opinions. It has been shown that increasing numbers of online ethics disputes were due to discussion and sharing of cases in social media without the patient's consent, including uploading or reposting patient images to reveal medical information. Nursing information literacy education needs to cover issues related to medical privacy ethics in a social media context to protect patient rights. This article aims to state the privacy rights of patients, consider information convenience that facilitates a violation of privacy and medical privacy disclosure, and share the teaching strategies and suggestions for ethical literacy cultivation of nursing information. This report aims to improve the ethical quality of using social media in nursing and encourage implementation of patient privacy protection.
