臺灣職業棒球運動的發展與弊案探討－從檢調機關偵辦角度觀察

2009年10月臺灣職業棒球運動爆發非法簽賭、職棒球員打假球弊案，時檢討改革之聲浪，或將責任歸咎於政府、或指責中華職棒聯盟運作不良、球團管理不當，或直指球員個人道德操守淪喪，亦有抨擊檢調機關偵辨洩密、養案、違反正當法律程序之反映，是否因當前社會環境及臺灣職棒結構出了問題？未來發展令人憂思。本篇採文獻分析及質性研究之深入訪談法，深入訪談偵辦弊案專案小組調查人員，旨在從檢調機關偵辦2009年中華職棒弊案角度，瞭解非法簽賭及黑道介入職棒狀況、探討弊案發生原因，提出職棒未來發展具體興革意見，供政府參考及後續研究。探討結果職棒弊案始終未能根絕，肇因於球員薪資偏低、球團管理鬆懈、地下賭盤頻仍、黑道活動猖獗、司法判決刑度過輕、檢調機關蒐證困難。建議給予職棒球員合理薪資、球團應落實內部管理，政府應大力掃蕩地下非法簽賭、綿密監控黑道介入，球員應潔身自愛、謹言慎行，誠實面對比賽，檢調機關應加強蒐證積極偵辦。結論：我國職業棒球運動發展過程艱辛，2009年檢調機關偵辦職棒非法簽賭打假球弊案，驚醒了政府與國人振衰起蔽之心，果能上下一心全力改革，中華職棒光明的未來仍是國人可期的。

In October 2009 the field of Taiwan Professional Baseball League broke out illegal gambling and game fixing among some of the professional baseball players. From that time on, the calling for reforms put the blame on the government or lash out the malfunction of the TPBL, the improper management of the corps and degenerated morals. Some even criticize that the prosecution and investigative agencies are involved in disclosure of concerned secrets, without abiding due process of law. Whether the problems are from the structure of the professional baseball league or social environment, the future development is truly worrisome. This article was base on both data analysis and qualitative research together with the interview of those members who are in charge of this case. The purpose of the research is to explore the causes of the scandals and the outcome shows that the scandles cannot be fully rooted out contributing to the comparatively low income of the players, the loose management of the corps, frequent underground gambling, rampant gangster activities, the lenience given by the penalty, and the difficulty of evidences gathering. So the conclusion would be that the players should be fairly paid, the corps should be properly managed, the government ought to positively sweep the illegal underground gambling, carefully controlling the interfering of the underground world. The baseball players should be alert of their words and deeds, behave themselves and honestly to play the game. The prosecution and investigative agencies ought to cooperate together; and aggressively investigate such crimes. The development of Taiwan professional baseball activities has gone through a hard process. The investigation of 2009 scandal case make the government and people all to concern the development of the baseball activities' future and make every effort to recover to normal condition. If the trickled-down reform can be carried out, it is still foreseeable for the TPBL to have a bright future.
