論人文精神與法理學教育

On Humanity and the Education of Jurisprudence

摘要


本文嘗試提出一項主張,亦即,法理學教育的目的,在於培養法律人具有人文精神。為了論證這項主張,全文包含三大部分。第一部分為現象的描述與分析。我根據對教學者與學生所做的實證研究成果,考察台灣法理學教育的部分現況,並對此現況進行比較分析與批判性的解讀。第二部分為論點的提出與證立。我以Martha Nussbaum的一篇文章做為思考起點,進而試圖論證:為什麼人文精神應該是台灣法理學教育的核心理念。最後,本文的第三部分則針對如何在法理學教育中培養人文精神的策略問題,提出我個人的看法與建議。

This essay attempts to argue that the education of jurisprudence should aim to cultivate the humanity of jurists. In order to justify this argument, the essay consists of three main parts. The first part is a description and analysis of phenomena. Based on the results of a positivistic survey to teachers and law students, I try to analyze and critically examine some phenomena shown at the education of jurisprudence in Taiwan. Then, the second part proposes some arguments to justify my main point, namely, cultivating humanity in jurisprudence. Started by introducing an article written by Martha Nussbaum, I intend to argue why humanity should be the core idea of the jurisprudential education in Taiwan. Finally, in the third part of this essay, I suggest some strategies which could possibly implement my proposal to cultivate humanity in the education of jurisprudence.
