本文分析台灣的就業保險失業給付制度在「積極促進」治理原則下,失業給付制度的設計與執行,對於失業給付領受者再就業意願與成效的影響。研究發現,在「積極促進」治理原則下,現行的就業保險失業給付制度在制度設計上,依照「個體化」與「例行化」原則,不僅制定出相對較低的失業給付標準,緊縮「合適工作」標準與「請領條件」,而且設計了嚴格的尋職行爲強制性規範;在制度執行上,則是採取不利於失業給付領受者的行政處份;二者共同構成失業給付領受者身處在「消極性參與」例行化尋職的處境中,導致再就業意願與成效不彰。面對現行就業保險失業給付制度的問題,改進建議包括:簡化失業給付認定流程;改變「單一窗口」制度,將失業給付與推介就業分開窗口受理;修改就業保險法,將特定對象失業者的求職證明有條件減少爲一次。
This article aims to analyze the re-employment wish and performance of unemployment benefit recipient's resulting from the design and implementation of Employment Insurance institutions in the mode of activation governance in Taiwan. The main finding is that employment insurance institutions according to activation governance principle, performing employment insurance institutions were designed in accordance with ”individualization” and ”routine”, not only relative low unemployment benefits levels and strict job-search regulations but also tighten suitable job criteria and imbalanced administrative discretion, bringing forth unemployed fall into the situations of routine job-search in the process of applying for unemployment benefits, it is the causes of unemployment benefit recipient's low re-employment wish and performance in the process of applying unemployment benefit. There are suggestions as follow: simplify the identity process of applying for unemployment benefits, dividing the ”one-stop window” into ”unemployment benefits applying window” and ”re-employment referral windows,” decreasing the job-search records of particular unemployed conditionally.
