摘要

兩岸長期敵對下，欠缺互信及協商機制，如何加強兩岸司法互助及合作，維護兩岸人民權益，實為兩岸政府當務之急。2009年6月25日兩岸簽署之「海峽兩岸共同打擊犯罪及司法互助協議」，已對兩岸司法互助產生正面影響，但實務運作上仍有不足之處。本研究試圖以多重視角分析兩岸司法互助的理論及實務，分別探討「海峽兩岸共同打擊犯罪及司法互助協議」簽署的背景、沿革及兩岸婚姻事件及公證書驗證作業，並分析實務上就兩岸假婚姻事件中所衍生事實認定及公證書等問題，期能增益兩岸司法互助機制，造福兩岸人民福祉。

Under the long-term cross-strait hostility, lack of mutual trust and consultation mechanism results in hard to make cross-strait judicial mutual assistance and cooperation, especially the document verification of cross-strait false marriage. The Cross-Strait Joint Crime-Fighting and Judicial Mutual Assistance Agreement had a positive impact on both sides of Taiwan straits, but there are still shortcomings on the practical operation. This study attempts to analyze the cross-strait judicial mutual assistance mechanism in multiple perspectives, and explore the issues of cross-strait false marriage event. For the benefit of people, Taiwan and mainland China need to build up mutual trust, and created win-win solution.
