區分所有的理論與實務

The Theory and Practice of Condominium

摘要


區分所有不限於建築物的區分所有,理論上土地也可能區分所有,因此,應稱不動產的區分所有。公寓大廈管理條例施行即屆滿十週年,在許多學者努力下,解決了許多區分所有和公寓所有權的爭議,然而,尚未解決的爭議也不少,在公寓大廈管理條例已屆滿十週年時,探討區分所有的理論與實務,仍具相當意義。 本文第二部分先概述區分所有的理論,作為探討和解決實務問題的基礎;第三部分深入探討專有部分的理論,敘述專有部分理論爭議所在,提出本文見解,並驗證條例的相關規定;第四部分深入探討共有部分的理論,作為解決實務問題的基礎;第五部分深入探討規約的理論,作為條例規定的理論基礎;第六部分先介紹實務上區分所有相關的問題,對照前述理論探討,提出本文見解,用來解決實務問題;第七部分總結全文,提出本文結論。

Condominium does not only apply to a building, theoretically a land condominium is still possible. Thus, real estate condominium would be a better name than building condominium. The Condominium Regulation Act is in force for ten years. Many issues concerning Condominium and unit ownership were solved by endeavor of lots of law scholars. However, there are still lots of issues unsolved. In the ten years anniversary of The Condominium Regulation Act, it is still quite meaningful to explore the theory and practice of condominium. The second part of this thesis generally narrates the theory of condominium as the basis to explore and solve the practical problems. Part three, part four and part five separately thoroughly explores the theory of individual units, common elements and agreement. Part six first introduces the concerning practical issues of condomium, then refer to the theory mentioned above, and proposes the contention of this thesis to solve those issues. Part seven is the conclusion.
