臺中市山地原住民區的法人地位與自治體發展

Legal Person Status and Development of Self- Governed Body in Taichung City's Mountain Aboriginal Area

摘要


有鑒於2010年12月25日臺北縣、臺中縣市、臺南縣市及高雄縣市改制為直轄市,伴隨著改制作業原為臺北縣烏來鄉、臺中縣和平鄉、高雄縣茂林鄉、桃源鄉及那瑪夏鄉亦隨同改制為區,即由原來自治團體轉變為非自治團體,引發部分原住民族團體強烈質疑違反憲法保障原住民參政權利之疑義及擔心原鄉地區被邊緣化等疑慮,為反應此一問題,中央修正地方制度法以恢復原住民區為自治團體,以維持其自治權限並保障住民權益,本文將就自治與非自治團體之區別及恢復原住民區為自治體是否真能保障其權利做探討及自治後所產生之問題提出建議為:一、儘速訂定原住民族自治法。二、改善硬體設施以促進觀光產業發展。三、和平專案應持續發揮功能。四、選舉制度應適度改良。

With the leading reorganization happened in Dec. 25, 2010 when some provincial counties and cities were upgraded as municipalities, Wulai township in Taipei county, Heping township in Taichung county, Maolin, Taoyuan, and Namaxia township in Kaohsiung county were also reorganized from self-governed communities to non-self-governed ones. However, some aboriginal groups begin to doubt the legality of this policy, question the core meaning of their suffrages which have been protected by the Constitution, and even worry the aboriginal areas will be marginalized. To solve this problem, Local Government Act was amended in order to maintain the aborigines' autonomy and protect their rights. Therefore, this paper will mainly discuss the differences between self-governed and non-self-governed communities, whether suffrages will be protected after reinstating as self-governed communities, and lastly propose some suggestions for those problems resulting from self-governance, such as seting up the aboriginal autonomy law as soon as possible, improving hardware facilities to promote the development of tourism industry, carring out Heping Project continuously and meliorating the electoral system.
