The Investigation of Political Cases in Post-War Taiwan: Taking the Illegal and Improper Investigation of the Intelligence and Public Security Unit as the Focus

摘要

1949—1992年間，臺灣有數以萬計的人民，遭統治當局以叛亂或匪諜罪嫌加以拘捕、審問和處罰，導致白色恐怖氛圍長期籠罩全臺。整體而論，統治當局對政治犯的處分頗重，然卻常見不法與不當的處置，往往對人權造成頗大的侵害。在處置政治案件的流程中，偵辦程序的啟動者是情治單位，往往扮演關鍵角色。本文首先討論情治單位的發展與系譜，其次討論情治單位偵辦政治案件過程中諸多不法或不當的作為，包括：不法或不當的拘捕，強暴、脅迫、利誘、詐欺、疲勞訊問，以及政治考量、密決、先辦人再找證據、未於拘捕後二十四小時內移送法院、不當羈押、製造假案等等。

During 1949-1992, there were tens of thousand people in Taiwan being arrested, interrogated, and punished by the ruling authorities with the suspicion of offense of rebellion or Communist agents, resulting in white terror atmosphere's haunting Taiwan over a long period of time. On the whole, the ruling authorities' disciplinary actions for political offenders were pretty heavy; however, the illegal and inappropriate disposal was often seen, and usually caused great infringement of human rights.In the process of handling political cases, the starter of procedures of investigation was the intelligence and public security unit which usually played a crucial role. The research discussed the development and organizational chart of the intelligence and public security unit first, and then talked about intelligence agency's many illegal or inappropriate actions during the process of investigating political cases, including: illegal or inappropriate arrest, violence, threat, luring by promise of gain, deception,third degree, as well as political consideration, secret execution, arresting first and then finding the evidence, not transferring to the court within 24 hours after the arrest, improper detention, and making a feigned case, etc.
