隨著台灣的社會變遷,我國需要長期照護者日增,個人乃至於整體社會均需嚴肅以對。而國家本於所負「實現人民享有人性尊嚴生活的照顧義務」(參見司法院大法官釋字第550號理由書用語),自然在面對社會上殷切期盼的長期照護議題,需要妥適規劃長期照護法制因應。有鑑於我國長期照護服務供給體系未臻完備,故在法制規劃上,自當以「健全長期照護服務體系」為首要任務,為此我國業已制定長期照護服務法草案,期能整合現行各類機構及人員之規範,以落實草案所欲「確保服務品質、保障接受長期照護者之權益」之目的。惟,本文認為草案容有可茲修正精進之處,故嘗試探究上開草案內容,並援引學理之分析,提出可供立法參酌之建議,以供完備我國長期照護服務體系之用。
As time goes by, satisfaction of living, health care and security need would become the main issues of people. According to official statistics, as of 2012, 2.60 million people, 11.15 percent of the population was aged 65 and over. By 2025, Taiwan's senior citizens are expected to account for one-fifth of the total population. Long-term care (LTC) has become an emergent social problem. In response to this trend, the authorities are creating a LTC Service Network. To provide accessible and quality services, a draft was under legislative review in mid-2011. But, how should we to increase its effectiveness and efficiency and how could we let people approach services easily? This article attempts to observe whether the draft focus on the Legislative purposes. This article also provides some advices to integrate, manage LTC- related resources, even to enhance the LTC services quality in the future.
