藝術教師使用教學媒體之相關著作權初探

Notes on Art Teachers in Taiwan in Use of Teaching Media

摘要


與一般科目比較,藝術教師較常於專業教室授課,使用的教學媒體,種類也較爲多元,但往往涉及「著作權」之「合理使用」與否之問題。本研究藉著: 一、藝術教師教學時放映的DVD,及上課播放的背景音樂非爲公播版本、教師使用掃描機從書本中掃描影像,製作成上課使用的Power Point檔案。 二、藝術教師教導的合唱團未使用正版樂譜,而使用影印之合唱樂譜。 三、修習藝術課程的學生做報告時,從影片中擷取畫面,並從他人的網站中複製文字、圖片及配樂,編輯到個人簡報中,乃至藝術教師於豐樂公園拍攝雕塑作品,再使用幻燈片於課堂中放映。 四、藝術課程的學生向老師商借,欲燒錄公播版DVD。 五、教師或學生剪輯錄影帶,轉錄爲VCD、從不同的DVD中截錄數個段落,燒錄成同一片VCD、於個人網站中張貼他人作品。 等等上述五個案例,依次淺探教師於藝術課堂上常見的著作權問題,以示充分尊重民主法治的精神,而自校園中,由教師自身的「修己以敬」率先示範做起。

Compared to general courses, art teachers often teach students in professional classrooms and use multimedia when teaching. This study researches the issue of intellectual property rights in art classes with five case examples of: 1. DVD played by an art teacher for teaching and music played in classrooms were not authorized versions. The art teacher scanned photos from books with scanners and produced them as PowerPoint for teaching purposes in classes. 2. Choir did not use the original copy of music books and instead photocopied choir song books. 3. When students wrote reports, they picked screen shots from films and copied the letters, pictures, and music from others' website to edit their own report. An art teacher took a picture of sculpture work pieces in Fengle Sculpture Park and played the slides in class. 4. Students borrowed DVDs from an art teacher to burn into unauthorized versions. 5. An art teacher edited video tapes, converted into VCD, cut several sections fromdifferent DVDs, burned into one VCD, and posted others' work piece on personal websites, and so forth. We hope to show our respects to the intellectual property rights, based on the spirit of democracy, to obey them from the teachers themselves strictly on campus.
