摘要

基於邇來中共物權法草案受到的熱烈討論，茲參考過去歐洲封建制前農村集體所有的社會現象，探討其中的社會關係，進而尋求其中的法律關係內涵，做爲團體所有理論的基礎法理，並與現代資本主義社會商品所有權的法律現象互爲參照，欲確認在目前各國私法法制在一味接受所有權商品化爲核心的法制之際，團體理論還是能提供不妨礙商品化交易復能與過去集體所有的社會關係相互融合的途徑。本文因此分就團體法的架構、大陸地區農地集體所有權的法律關係、共物權立法的檢討析述之。

In the hope of the theory can provide a way that new law don't impede commercial transaction, and have regard to fuse together with the tradition social system at the same time.
