不動產變動登記之探討-兼論美國不動產登記制度

A Review on the Recordation of the Variation in Rem of Real Property-the System of the Recordation in Rem of Real Property in USA

摘要


不動產物權登記,我國現行民法,僅設有兩個條文加以規範,一爲民法第七百五十八條之「設權登記」,另一則爲民法第七百五十九條之「宣示登記」。前者以登記作爲不動產物權變動之生效要件,後者則以登記作爲不動產物權之處分要件。 我國不動產變動登記既採取形式主義之立法,爲彌補形式主義之固有缺陷,才產生形式主義與意思主義在物權立法之交錯現象,故立法上仍應遵循形式主義之公示與公信原則,只有在特定場合,需要借以意思主義方法時,才作出例外之規定。

The recordation in rem of real property has two articles up to standard. One is Article 758 concerning the juridical act will not effect until the recordation has been made. The other is Article 759 concerning dispose of such rights until recordation has been made. The recordation in rem of real property in our country has adopted the legislation of the principle of the formality. In order to make up for the defect of the principle of the formality, so that it comes into existenceto interlace the phenomenon of the principle of the formality and meaning in the legislation of the rem of real property. Therefore, the legislation should follow the principle of the open and public credibility of the principle of the formality. Only in the special occasions, it needs the way of the principle of the formality. It should be exceptional regulations.
