消費者保護法上與商品責任等價的服務責任

The Service Liability Equivalent to the Product Liability in Consumer Protection Act

摘要


消費者保護法第7條所指的服務概念有三項要素:其一,不再用於生產的最終服務;其二,提供服務的企業經營者,亦即企業經營者須從服務中獲利,這項要件無疑是英美法上無過失服務責任的商業上交易要件的轉化;其三,企業經營者提供的服務,須具有依當時科技或專業水準不可合理期待的危險,在這樣的要素理解下,不僅醫療行為本來就不應該是消費者保護法第7條所指的服務,投資服務(包括連動債)與保全服務均非該條所指的服務。從而提供這類服務的企業經營者,都不負有無過失的損害賠償責任。

The concept of Service in the Consumer Protection Act Article 7 referred to three elements: First, Service is final and no longer used for production; second, the business operators who are engaged in the providing services, are required to profit from the service, the elements is transformed from the concept of commercial transaction in strict liability of common law; third, provided services shall have a safety or health risk, under the understanding of this factor, not only medical service should never been referred to concept of service in Consumer Protection Act Article 7, but also investment services and guard services are not within it. Business operators who are engaged in the providing services do not bear the strict liability for damage.
