摘要

中醫推拿助理之存在與定位問題，一向爲主管機關所漠視，長久以來一直處於法律之灰色地帶懸而未決。而坊間中醫診所僱用非醫事人員執行推拿業務已行之有年，且爲公開不爭之事實，其工作之性質與人民健康公共福祉相關，卻不具有任何合法之地位。
本文綜合歸納歷代中醫推拿助理文獻、中國大陸相關制度與我國法院實務見解，討論當前醫事法令與行政措施應改進之方向，希冀進一步解決此一多年難題。

Regulatory bodies have been ignoring the existence and positioning of tui-na assistant in traditional Chinese medicine (TCM) profession for quite a long time. It is indisputable that TCM clinics hire staffs without proper training for the purpose of providing tui-na to patients. Although the work is closely related to public health, it is not legitimate.
This article has concluded archived documents related to TCM assistant, relative regulations in China and Taiwan Court Practice in order to discuss a proper change for current regulations and administration.
