摘要

歷經漫長談判，中國大陸於2001年11月10日通過世界貿易組織入會案，成為該官方國際組織第143個會員該組織向來有經濟聯合國之稱，對於中國大陸智慧財產權的法律體系而言，正是邁向經濟全球化的歷史新頁。審視世界貿易組織的成立目的，乃在於提倡自由貿易精神，除卻關稅障礙，強調開放市場，分享經濟主權，並就會員國彼此間因不同的規範制度所引發之相關爭議，尋求共同的解決機制，如《爭端解決規則與程序瞭解》，可說為兩岸對話開闢一扇窗口。而在高科技產業、知識經濟高度發展之際，中國大陸如何因應加入世界貿易組織後的經濟全球化趨勢，調整內部對於智慧財產權利的保護和實施機制，則在於其立法政策的變遷可見端倪。鑒往知來，在中國大陸與美國貿易摩擦升高的當代，回顧二十年前中國大陸的應對舉措，對於未來中國大陸智慧財產法制變革將能有所掌握，此亦為本文之研究目的。

After lengthy negotiations, Mainland China passed the World Trade Organization (WTO) membership case on November 10, 2001, and became the 143rd member of the official international organization. This organization has always been known as the Economic United Nations. For the intellectual property rights legal system in Mainland China, it is a new page in the history of economic globalization. The purpose of examining the founding of the world trade ancestor is to promote the spirit of free trade, remove tariff barriers, emphasize open markets, share economic sovereignty, and seek a common settlement mechanism for related disputes caused by different regulatory systems among member states. For example, "Understanding Dispute Settlement Rules and Procedures" can be said to open a window for cross-strait dialogue. With the rapid development of high-tech industries and the knowledge economy, how mainland China adjusts its internal protection and enforcement mechanisms for intellectual property rights in response to the trend of economic globalization after joining the World Trade Organization depends on the changes in its legislation and policies. Looking back on the past and knowing the past, in the contemporary era of rising trade friction between mainland China and the United States, looking back at the response measures of mainland China 20 years ago, we will be able to grasp the future changes in mainland China's intellectual property legal system, which is also the purpose of this article.
