隨著國內外勞人數的增長,外勞人權的議題逐成為國內勞工團體關注的重點,尤其是若干侵害外勞人權事件發生以後,包括惡劣勞動條件、強迫勞動、性騷擾及侵害,以及社會對外勞的結構性歧視等,一直都是勞工團體倡議外勞人權保障的主要方向。本文除針對外勞政策的本質進行剖析,突顯在雇主追求降低勞動成本的邏輯之下,外勞的人權保障普遍不彰。尤其,透過雇主倡議外勞工資與基本工資脫鉤分析,戳破官方外勞補充性原則的政策謊言。此外,本文嘗試透過兩項明顯侵害外勞人權事件的分析,刻劃台灣外勞人權的圖像。最後,本文亦提出具體政策主張,希望能夠釜底抽薪的解決外勞人權問題,其中包括逐步走向移民政策,透過移民解決國內人力短缺,以及透過享有同等國民待遇的方式,提升移民勞工的權益。
With the increase of foreign labors in Taiwan, the human right of them become the key issue of domestic NGO. Harsh labor conditions, forced labors, sexual harassment and exploitation as well as discrimination are key focuses concerned by the human rights NGO. This article will analyze related policies concerning the human rights of foreign labors and review the deficiency of current enacted law. Besides reviewing current policies and laws, this article will provide concrete suggestion and solution to improve the human right protection of foreign labors in Taiwan.
