南海仲裁案與國際關係－初探仲裁結果對東亞局勢的影響
South China Sea Arbitration Case and International Relations: On the Influence of Arbitration Result on East Asian Situation
摘要
南海仲裁判決已經出爐，雖然中國從頭到尾表示對仲裁的過程與結果不參與、不接受、與不理會的態度，但由於仲裁庭是屬於聯合國海洋法公約附件七所衍生的機構，仲裁結果會成為與該爭議相關國際事務的重要參考指標，也會成為具一定法律規範性的文件。各國如果依據仲裁結果，延伸出若干與判決書精神相符的相關作為，會進一步讓實質放大這個仲裁結果，使其在經過相關國家不斷的確認或接受後，建立起一定程度的約束力。本文嘗試探討美國影響這些國家的程度、判決對於南海爭議聲索國的影響以及判決結果對於相關國家可能會帶來新的合縱連橫，由此窺探未來南海情勢與東亞關係發展。

South China Sea arbitration verdict has been released, Although China from beginning to end that the process of arbitration and the results do not participate, do not accept, and ignore the attitude, However, since the arbitral tribunal is a body derived from Annex VII of the United Nations Convention on the Law of the Sea, the outcome of the arbitration will become an important reference indicator of international affairs related to the dispute and will become a legally normative document. Each country, if it is based on the outcome of the arbitration, extends a number of related actions that are consistent with the spirit of the verdict, which will further allow the substance to enlarge the arbitration result and establish a certain degree of binding after confirmation or acceptance by the relevant State. This paper attempts to explore the extent to which the United States affects these countries. The impact of the judgment on the disputed country of the South China Sea and the outcome of the judgment may bring new vertical and horizontal links to the relevant countries, thus spying on the future development of the relationship between the South China Sea and East Asia.
