論私人參與國家機關之資訊蒐集活動—以線民之遴選運用及電信業者之協力義務為中心

A Study of Private Participation in the Information Collection by Government-Focusing on Citizen-Informants Application and the Obligation of Telecommunication Service Providers

摘要


本文以線民之遴選運用及電信業者之協力義務為例,探討私人參與國家機關資訊蒐集活動之容許性及其相關之法律問題。在民營化的浪潮下,干預行政任務之屢行雖然可以採取公私協力合作之模式為之,但仍有一定之界限。就此而言,國家任務中具有「權力獨占」性質者,乃「國家保留」事項,在以公私協力合作之方式屢行時,充其量僅能採取功能民營化之模式,而不得進一步成為實質民營化。無論是線民之遴選運用抑或電信業者之協力義務,均無違反以上之民營化界限。國家若透過強制方式,要求私人參與國家任務之履行,必須遵守法律保留原則、比例原則等法治國家之要求,尤其在費用負擔的部分,不得對人民造成過度之干預。

The purpose of this paper is to address legal questions of public private partnerships in area of the information collection by government. In view of preceding research purpose, the question of the admissibility of public private partnerships in area of administrative intervention is posed. Even though from a constitutional standpoint the idea of public private partnerships in area of administrative intervention is not absolutely prohibited, it has some limitations. More specifically, the material privatization of the state monopoly on the use of force is inadmissible. Neither the use of citizen-informants nor the data retention by Telecommunication Service Providers crosses these constitutional limits. It must further be noted that the principle of proportionality should not be violate when the private participation in the Information collection by government is obligatory.
