性別工作平等法的案例分析與實施現象探討

Case Study of the Act of Gender Equality in Employment and Exploration of Implementation Phenomena

摘要


在國際性別主流化思潮的影響下,台灣也制定了「性別工作平等法」。此法基本上分成三個範圍:1.性別歧視的禁止2.性騷擾之防治3.促進工作平等措施。在就業與經濟方面,藉由工作機會的保障、母性角色的支持、建立相關配套措施以提升女性在職場上的角色地位,達到性別平權之目標。「性別平等」是世界公民必要的公民素養,更是全球職場「禁止就業歧視」的發展趨勢;本文將從「性別平等的思想潮流與立法依據」談起,再分析職場上的性別歧視案例;進而探討性別工作平等法所遇到的實施現象,包含實施問題與爭議;最後提出職場性別平等的實施建議。

Influenced by the ideological trend of the international gender mainstreaming, Taiwan has also enacted the "Act of Gender Equality in Employment," which is basically divided into three scopes: (1) prohibition of sexual discrimination; (2) prevention of sexual harassment; (3) measures to promote gender equality in employment. In aspects of employment and economy, the relevant complementary measures are established, by means of guaranteed employment opportunities and support for maternal role, to improve the female role and status in the workplace and achieve the goal of gender equality. "Gender equality" is the necessary civic literacy for the global citizen and also the developing trend of "Prohibition of Employment Discrimination" in the global workplace. This paper will first discuss the ideological trend in gender equality and sources of law, then analyze cases of the sexual discrimination in the workplaces, and finally explore the implementation phenomena that the Act of Gender Equality in Employment is encountering, including implementation problems and disputes. Some suggestions on implementing the gender equality in the workplaces are made at the end.
