摘要

我國對於離婚夫妻未成年子女監護權的判定以夫妻雙方協商為優先考量，若雙方有爭執時才介入判定監護權之歸屬，但夫妻雙方的協商和法官自由心證的判決，監護權歸屬是否符應兒童最佳利益，關係著能否贏得未成年子女的未來。基於此，本文採文獻探究方法與案例研究分析，研究範圍為探究監護權爭奪中對孩子的影響及避免落入單親高風險家庭。研究結果：在父母因離婚無法提供一個完整的家庭給孩子時，國家必須更加為孩子最佳的生活環境做長遠的考慮，不管是社工人員人力不足、負荷過重，亦或是資源分配問題，必須做檢討，國家應扮演更稱職的家長角色，才不會讓孩子成為最大受害者。

Based on this, this article uses literature analysis methods and case study analysis approach, The scope of the study, that explore about children in the custody of contention and avoid falling into the single parent of high-risk families.The results that show divorce parents can not provide a complete family to the child, that the state must be more optimal living environment for the children as long-term thinking, whether it is lack of human capital, social workers are overloaded or resource allocation problem, it must be done review, Government departments should play the role of a more competent parent, that will not let their children become the biggest victims.
