摘要

隨著世界潮流的發展與現今社會對於多元婚姻制度有著不同的憧憬，同性婚姻的合法化問題為目前世界最具爭議性話題。各國家支持聲浪與反對立場峙立不下，積極爭取LGBT(女同性戀者（Lesbians）、男同性戀者（Gays）、雙性戀者（Bisexuals）與跨性別者（Transgender）的英文首字母縮略字)之權益，於2003年時，行政院提出《人權保障基本法》草案，該草案允許同性婚姻，並與享有異性戀夫婦相同的權利保障，但始終未進入立法程序。我國現行法律上在婚姻權上只准許「一男一女」的結合，對於LGBT之權益，維護多元性別之人的婚姻自由裡，台灣伴侶權益推動聯盟致力爭取婚姻平權，從各面向進行權益的提倡，例如：教育、文化、法律、社會價值觀，藉此消除性別、性傾向的歧視，使其多元性別之人皆能獲得平等與合理的法律保障，推動出多元成家方案。2013年10月25日，立法院於民法親屬、繼承篇部分條文修正草案一讀通過，使婚姻平權實為我國婚姻制度裡多元性別之人的一大躍進，讓性傾向不同的人，能有個合法的法律制度，也盼望給予法律上的保障。

Rapid changes of the world trend and reform regulation in pluralism marriage system make people become more aware of this matter and are highly expected for the future development . The legitimacy for same-sex marriage is the most controversial issue in the world currently. Some countries support the same-sex marriage while the others are not, which makes the issue more complicated and unsolved. In order to strive for the rights among Lesbians, Gays, Bisexuals, Transgender, The Executive Yuan proposed the Bill Guarantee of Human Rights of the Basic Law in 2003, which enables the same-sex marriage to share the same rights as heterosexual couples do but this proposed regulation is still remains unpassed. one man and one woman marriage is only acceptable in the current law. Taiwan Alliance to Promote Civil Partnership Rights is working earnestly to promote the equal rights for LGBT through different aspects, such as education, culture, law, social values. Their goal is to eliminate the gender sexual orientation discrimination. The idea for promote Pluralism family formation bill is to make the Pluralism gender can have equal and reasonable protection. In October 25, 2013, The Legislative Yuan passed the amendment of Civil Code Family and Succession for the first stage. This is a progressive legislation in Taiwan that makes people of different sex orientation can share same equal rights and legal basis through a legitimate procedure.
