摘要

本文探討病人醫療資訊隱私權與新聞自由之衝突與調和。公眾人物或市井小民就醫時，應如何維護疾病隱私？何時須放棄其對於個人疾病隱私之自主與控制而屈服於所謂的新聞自由所揭諸之公共利益？值得關注。本文首先界定醫療資訊隱私權與新聞自由兩個概念；其次以現實生活中新聞事件為探討基準，從病人醫療資訊隱私權與新聞自由可能發生衝突的不同面向分析，歸類發生衝突的態樣；最後對於此兩基本權利衝突時提出調和之衡量原則，以作為醫護人員考量維護病人醫療資訊隱私時之行為基準。

This article is a discussion of conflict and compromise between the right to privacy of medical information and press freedom. It is worthwhile to research into whether or not a patient should abandon the liberty of right to privacy of health condition under the pressure of press freedom. The fact that so-called public interest brought by the press freedom coincides with patients' reasonable expectation of privacy is focused. The concept of the press freedom and right to privacy of medical information is firstly defined. Secondly, on the basis of news events, the possible conflicts between the right to privacy of medical information and the press freedom are analyzed and categorized. In order to help health care workers to protect the right to privacy of health information for patients, the criteria for mediating two basic rights is finally provided.
