從基層地方選舉罷免看地方自治發展的困境與衝擊：以雲林縣林內鄉鄉長罷免個案為例

摘要

台灣政府體制長時間為中央集權，資源的分配一向集中在中央，地方談不上自治權力，隨著政治自由與民主開放，政府體制逐漸朝向地方分權發展，透過基層選舉的實施，地方自治才得以逐步實踐。
從長期政治觀察與接觸，基層地方選舉與地方自治實施發展有很大關係，本研究內容主要探討：一、選舉「制度面」與「非制度面」對實施地方自治發展的影響？二、地方自治在基層選舉中發展，其困境與衝擊為何？三、以雲林縣林內鄉鄉長罷免個案為例，探討說明地方政府在執行地方自治事項，當地方民意與地方政府執行政策方向未能一致時，地方政府的自治權限是否受到干擾？試圖由基層選舉的一些政治現象，說明地方自治發展之困境。
為因應自治實施面臨的困境，個人認為：第一、落實地方自治，應從實務面著手檢討，配合立法機關修法，建立完善的制度及法規。第二、改善惡性循環的基層選舉文化，根本做法應從公民教育做起，形塑良好的公民意識，建立公民典範，如此地方自治實施才得以落實。

The government system of Taiwan has been centralized for a long time. The resource distribution has always been focused on the center, and locality doesn't have relative autonomic power. Following the political freedom and liberated democracy, the government system gradually developed toward regionalism. In time, local government gained the power to make policies, and through the implementation of election, autonomy could be carried out step by step.
Through long-term observation and contact with politics, basic local election is extensively drawn in to the development of autonomy. This research is mainly to study: 1. How would the system side and non-system side of election affect the functioning of autonomic development? 2. What is the role and impact of autonomic development in central election? 3. With reference to the case of the repeal of the Chief of Linnei Township, Yunlin County, to discuss and explain if the local government's limits of autonomous authority will be interfered with, if the government executes autonomy issues. Is the direction of local public opinion and local government's policies different? How can public opinion affect the government's policies through political means like election repeal? I will try to explain the development and role of autonomy in central election's political phenomenon.
In order to deal with the problem of carrying out autonomy, I personally think: First of all, fulfilling autonomy takes concrete and practical analysis along with modification of laws by legislative institutions to build a complete system and legislation. Second, in order to change the vicious circle of central election culture, the crucial process should start with citizen education, building good citizenship and citizen roll models, thus the practical application of autonomy can be fulfilled.
