當諮商心理師進入法院：心理諮商專業在家事司法中之多元實踐及展望

摘要

2012年所制訂和實行的家事事件法，主張以跨專業整合和訴訟外紛爭解決的機制來減低家庭紛爭與保障兒少和受監護者之權益。諮商心理師因其所具備之諮商專業，而可能成為家事司法中的程序監理人、家事調解委員、家事商談員、諮商心理師或家事調查官。有鑒於心理諮商專業與家事司法體系間之互動漸趨緊密，但相關論述卻付之闕如，本文擬以諮商心理師為主體、家事司法體系為書寫背景，佐以臺灣諮商領域中之研究，勾勒出心理諮商專業於目前家事司法中的實踐形貌。而因心理諮商之專業定位尚未於家事司法中確立，本文亦就「諮商心理師在家事司法實務中的倫理議題」及「諮商心理師需主動展現專業於家事司法實務」兩個命題嘗試闡述及開拓心理諮商在家事司法中建立專業定位之可能性。
