2008年為聯合國世界人權宣言公佈六十週年,全球有系列慶祝紀念活動,人權基本上是一個具體化的道德與倫理的呈現。聯合國世界人權宣言(Universal Declaration of Human Rights, UDHR)及國際經濟社會與文化權利公約(International Covenant on Economic, Social and Cultural Rights, ICESCR),視社會安全權為基本人權,本文擬從「社會安全權」內容為啟始,探析世界人權宣言及國際經濟社會與文化權利宣言等相關社會安全權的梗概,接著進一步探討ILO社會安全最低標準公約內容的變遷,及其實踐社會安全權的角色與其相關的影響面向,以及所面臨的新挑戰與新趨勢,並檢視台灣社會安全制度在實踐「社會安全權」的成果,以及面對新變遷趨勢該有的省思與作法。
2008, sixty years from Universal Declaration of Human Rights, UN announced, series celebration activities host around the world. Basically, human right is a concrete presentation of moral and ethics. The right to social security has been fully recognized as a basic human right by Universal Declaration of Human Rights (UDHR) and International Covenant on Economic, Social and Cultural Rights, (ICESCR). This article begins with the overview of ”Social Security Rights” exploring relevant principles from Universal Declaration of Human Rights, (UDHR) and International Covenant on Economic, Social and Culture Rights, (ICESCR). Then, further discuss the development of International Labor Convention No. 102, the role of implementing Social Security Rights, other impacts, coming challenges and new trend. Finally, examine the implement of Social Security Rights in Taiwanese security system to generate reflection and new strategy toward coming future.
