摘要

水土保持是整體性、長遠性、預防性和防災性之工作。水土保持法及其子法規為規範山坡地水土利用之寶典，因為牽涉範圍極廣，雖經數次修訂，但仍存在許多爭議。本文之探討重心分兩部份，一方面針對「水土保持計畫審核監督辦法」規定施工檢查之應注意事項與缺失，探討易發生的缺失、法條修改、表格格式修改，增修施工檢查表項目，如界樁、夯實度、變更設計、滯洪池排放口合適度、安全性等，並將檢查事項分類明確與盡量量化，以確保施工品質及安全。另一方面，審酌水土保持法對於「限期改正」之立法精神，參照現行水土保持技術規範等加以研究分析，以降低災害發生為目標。藉此提高整體限期改正處分品質、降低執行偏差及指定改正事項不適當的情形並加強限期改正後之檢查，提昇對相關限期改正方式之指導能力及技巧，以落實山坡地管理工作。

Soil and water conservation is an integrated, long-term, preventative and taking precautions against natural calamities work. Soil and Water Conversation Act and its sub-regulations is the guideline of the hillside utilizing. Because it involves extremely widely. After several revisions, there are still a lot of disputes.This paper divides into two parts, one is to discuss the incident deficiency, regulation article revise, and form revise focusing the construction check of ”Soil and Water Conservation Plan Verify and Supervision Method”. We modify the items of the form of construction check, such as boundary stake, compacted density, altering the design, the exit of detention pond, security of the design etc. for check construction quality and security.The other one is to check the relevant regulations of ”The Cure within a Prescribed Time Limit” of Soil and Water Conservation Act. And we follow the Soil and Water Conservation Code to reduce the calamity, to improve the quality and situation and to strengthen the inspection after ''The Cure within a Prescribed Time Limit”. And also we can promote relevant guidance ability and skill to implement the hillside management.
