原住民族電視台設台以後,因相關法令和配套措施未周全,以致原民台一開台即由具濃厚商業色彩的電視公司得標,且一年一標高度變動性無法累積經驗。之後,因『無線電視事業公股處理條例』相關規定,原民台之節目必須移撥到「公視基金會」來製播,開始了原民台寄寓於公廣集團的命運。而後『財團法人原住民族文化事業基金會設置條例』的通過,規定原民台應納入基金會,原民台由此條例似乎可重獲其主體性。然而,媒體觀察者和傳播學者質疑這種由原民會主管的基金會無法擺脫政府的介入,未符合黨、政、軍退出媒體的精神,主張原民台應留在公廣集團才能保障原住民族媒體進用權的主張。本文認為,要建構具有原住民族主體性之電視台之正當性,要從國內外有關原住民族傳播權相關的法律規定以及『聯合國原住民族權利宣言』,探討設置一個原住民族自主、自治的原民台的適法性和正當性。也要從多元文化主義有關媒體論述之進路,探討原民台和公廣集團的關係,因為對於原民台和原住民族而言,公廣集團不單是一種新形式的新傳播帝國主義,且其實踐的是一種同化性質之意識型態。最後,為建構符合黨政軍退出媒體,並維護原民台的自主性,可借鏡國外設置原住民族電視台的經驗,提出原民台單獨立法的建議,以建構一個專屬原住民族的公共頻道。
Taiwan Indigenous Television (TITV) was always criticized by its non independent character; from 2005 to 2006, TITV was managed by some non-indigenous commercial televisions; and from Jan. 2007 to date, TITV was managed by Taiwan Public Television Service Foundation (PTS), by the Wireless Television Enterprise Government Disposal Ordinance. However, current being managed status violates the Indigenous People Cultural Foundation Establish Act, which legislated in Dec. 2007. Many scholars of communication and media support that the PTS should keep managing TITV to avoid the intervention from the controlling agency of the Act in government- Council of Indigenous Peoples Affairs, Executive Yuan. I argue neither the Ordinance nor the Act would probably make TITV autonomous. The Act is controlled by political party and ruling government, and the Ordinance is somehow bowed to mainstream value. I claim a complete and independent TITV Law is necessary to admit TITV an independent character.
