臺灣以議會內閣制取代半總統制之可行性分析

摘要


九七憲改後所確立的半總統制,迄今已然運行超過二十年。然而直至今日,卻亦能發現不論學者專家或名嘴、民眾,仍有呼籲憲政體制修正的聲浪傳出。難道,半總統制對臺灣憲政發展真如普羅大眾所述,問題重重而不得不修正?又或者轉型為其他憲政體制後,對臺灣整體社會、政治情勢,能夠帶來另一種利大於弊的優勢?本文以此作為探討出發點,從應然面、實然面兩種角度做出探討,並分析取代現行運作之半總統制的可行性。

The Semi-presidential system has been implemented for more than 20 years since 1997 Reform. However, there have been experts', pundits' and public's voices of reforming. Is it true that Semi-presidential system must be reformed for a series of problems? If the Semi-presidential system is replaced by another constitutional system, can it benefit our society and political situation? In the study, the questions will be discussed from perspectives of Law and real situation, and analyze the possibility of replacing existing Semi-presidential system.
