台灣勞動派遣法規草案與中國勞動派遣法制之比較

The Comparisons of Dispatcher Employment Legislations between Taiwan and China

摘要


變化迅速的經營環境迫使企業必須調整其架構,使能彈性因應顧客需求和供應鍊的瞬息變動,而彈性勞動力則是彈性組織的基礎,特別是派遣勞工。派遣勞工、派遣企業和要派企業之間的多角關係引發複雜的勞資關係,而企業規避雇主責任、派遣勞工承擔較高的就業風險,更造成許多勞資爭議。近年來台灣的派遣勞工逐年遞增,而中國的派遣產業更是迅速擴張,本論文主要在比較台灣和中國勞動派遣法制的異同,以釐清相關概念與實務內涵,期能更有效地保障勞工與企業的權益。

Modern enterprises need to redesign their organizational structure to meet the fast-changing consumers' needs and supply chains. A flexible workforce is the foundation of flexible organization and make employment of temporary workers necessary. The atypical relationships between temporary workers, temporary employment agencies and client companies create not only complex interactions but also employment disputes. The purposes of this study is to compare temporary employment legislations between Taiwan and China, in order to better understand protection of workers' and companies' rights.
