美國生技產業的法規政策對我國的省思

美國作爲生技產業的大國，其對於生物科技產業的法律規範以及政策，對於我國在大力發展生物科技產業的同時具有重要的參考價值。本文認爲，在科技面向的技術開放與否議題上，我國在對於技術本身專利與否則似乎更應考量我國的國情。其次對於生物科技面的相關法律議題，我國應在個人權利保護以及產業競爭秩序的實踐上向美國經驗借鏡。至於在生物科技的產業補助上，即使由於我國本身的先天因素，不同於美國而產生政府高度介入產業的現況，但是我國在藉由研發經費補助而介入主導產業發展的過程中，必須加強其理由說明以支持其主導產業發展的正當性。

To be predominant in bio-industry in the world, the experience of making law and regulation relating to bio-industry in the United States is as valuable as the government in Taiwan is developing such industry. As indicating in this article, from the aspect of opening technology development, we should put more consideration upon and restrain in patentability of these technologies. And from the aspect of concerning legal issues with those technologies, the observation is that the government in Taiwan should gain experience form the United States in dealing with personal rights and unfair-competition violation. Last, in this article, as to the aspect of industrial financial support out of government funding, even though this article is recognized that Taiwan's equipped with specific consideration in developing the industry different form the United States causes the highly deep governmental involvement with bio-industry, the suggestion of this article is that our government should reiterate the reasoning of leading the bio-industry by way of financial support from government funding statement in process of making it real in order to justify it.
