各國個人醫療資訊隱私標準之法制研析

摘要

本研究分別針對美國、英國及日本三個國家之醫療隱私標準運作的相關立法、醫療隱私標準運作程序、醫療隱私標準運作內涵來進行介紹，探討個人醫療資訊隱私所應考慮之原則、標準與立法方式，歸納整理醫療資訊保護所應納入的精神、運作方式，進而提出相關立法的建議，作爲我國推動醫療資訊隱私與安全運作之參考。

This article introduces the legislation and standard of procedure on health information privacy rule in US, UK and Japan. In this article, we analyze the practice of legislations and standards on health information privacy in these countries in order to make suggestions on planning the lawmaking about health information in Taiwan.
