臺北地院民事判決適用兩人權公約之分析

摘要

基層法官適用兩人權公約的情形較少受到關注，本文以兩人權公約施行後，臺北地院適用兩人權公約的民事裁判為分析對象，希望瞭解臺北地院民事庭法官適用兩人權公約之裁判數量、案例類型、所適用的兩人權公約標準及因此所表示之法律見解，並提出觀察心得，最後提出如何協助法官有效了解及適用兩人權公約標準之建議。

Little notice has been taken of the way in which District Court judges apply the two Covenants. Hence, this paper analyses civil decisions made by the Taipei District Court in which the Covenants were applied after they came into force domestically. The author examines the number of times the Covenants were applied, the type of cases involved and the human rights standards appealed to. He also looks at the opinions of the judges. He concludes his observations by making recommendations in terms of how to effectively and efficiently help judges understand and apply the human rights standards established by the two Covenants.
