地質法做為減災工具之初探-空間相關法令之銜接

Convergence between Geological Act and Space Related Regulations toward Hazard Mitigation: A Preliminary Study

摘要


本研究以「地質法」為核心,連結「區域計畫法」、「都市計畫法」、「非都市土地使用管制規則」等空間相關法令,以文獻探討、焦點座談等方法,檢視目前各法銜接的介面與問題,期能降低災害發生之風險。本研究共召開3場焦點座談,21人次專家學者與會,研究成果發現,地質法之定位為地質資訊揭露,不具備土地管理之實質內涵,亦無土地開發許可否決權機制;在空間發展機制之銜接上,仰賴現有土地管理法規並從其規定。若欲利用地質敏感區進行土地使用管制,需由地方政府或目的事業主管機關建立或委託地質專業,依其目的進行地質敏感區之危害度分級,並加強基地地質調查及地質安全評估之審議機制,健全地質資料提供制度,始能確實達成地質災害預防、減災之目標。

This study used literature review and focus groups to review the status quo and the problem of convergence among Geology Act, Regional Planning Act, Urban Planning Act, and Regulations on Nonurban Land Use Control, hoping to reduce potential landside risks. A total of 3 field focus groups were convened and 21 person-time expert scholars were invited in. The main outcomes from this study are: (1) Geology Act is defined as geological information disclosure to the public instead of management of land use; (2) It is not entitled to veto or deny land development in any form; (3) In regards to spatial development mechanism convergence, it must rely on current land management and control regulations completely; (4) Land use control must be complied with geological-sensitive area censorship conducted by professional technicians or authorities by local government or certified authority; (5) Establishing a review mechanism of geological survey on site selection and safety assessment to ensure geological information disclosure, as well as to achieve the goals of prevention and mitigation of geological hazards.
